eSocial SST events for public bodies

In January 2023, the obligations for eSocial OSH events for public bodies begin. Public bodies are included in the 4th group of obligated parties, being the only group that has not yet entered into force.

Group 1 has been mandatory since 10/13/2021, while groups 2 and 3 have been mandatory since 01/10/2022, and are subject to penalties, as of 01/01/2023, if they are considered to be in default regarding the failure to send SST events, or late submission.

With regard to public bodies, some peculiarities must be observed depending on the type of contract. Thus, in order to know the mandatory rule for sending OHS events, the hiring and social security regime of each public servant must be analyzed, and not of the body as a whole. Know some of these rules:

  • Public body that hires according to the rules of the CLT (public employment) and, consequently, has employees linked to the RGPS: in this case, the sending of events S-2210, S-2220 and S-2240 is mandatory;

  • Public body in which its employees, although statutory, are linked to the RGPS: all SST events (S-2210 and S-2240) must be sent, except event S-2220;

  • Public body that instituted RPPS, but has servers that are mandatorily linked to the RGPS: all SST events (S-2210 and S-2240) must also be sent, except event S-2220;

  • Public body whose statutory servants are linked to an RPPS: there is no obligation to send SST events.
